I attacked one of the guards and it said I was outlawed but all the guards would do was whistle. I was free to do as I pleased throughout town. I then attacked one of the guards repeatedly and he decided to take me down.

Outlaw system is different now. It can be very lenient on very harsh depending on what they are set at. For example you were free to do what you wanted even though you attacked a guard, but if you killed it or a PC then you'd get killed repeatedly. I was killed 20+ times until I was forgiven by the Fort Eldion at one point.
