Cube bug, Tyrael not cubed for newbie killing

Tyrael killed my newbie and another at least 6 times all together without getting cubed. I'm not sure how this is possible, but it shouldn't be.

were you hostile to him? was anyone in a party with you? were THEY hostile to him?

then most likely 1 of your party members was hostile to him, allowing him to freely kill you and anyone else in your party, its a *** mechanic, but thats how it works
